Patent Infringement Suit filed by Seoul Semiconductor Co.,Ltd.
Nichia Corporation ("Nichia") announced today that Seoul Semiconductor Co., Ltd. ("Seoul Semiconductor") filed a lawsuit against Nichia for patent infringement in the United States District Court for the Eastern District of Texas on October 6, 2007.
The complaint that was filed revealed that the patent-in-suit is not regarding the technology originally developed by Seoul Semiconductor but instead is the patent that Seoul Semiconductor purchased, the transfer of which was registered on the date of Seoul Semiconductor's filing of the said lawsuit against Nichia.
Nichia believes that no Nichia products infringe the patent in suit and that the said patent should be invalid/unenforceable for multiple grounds. Nichia is confident of its ability to prove the same in court.
Nichia has been vigorously protecting its intellectual property rights against Seoul Semiconductor by filing lawsuits against Seoul Semiconductor for its infringement of Nichia's patents in Korea, the United States and Japan. In fact, on November 8th, the jury unanimously rendered a verdict that found the willful infringement of all four Nichia design patents-in-suit by Seoul Semiconductor in the infringement lawsuit in the United States District Court for the Northern District of California brought by Nichia against Seoul Semiconductor and its US subsidiary, Seoul Semiconductor, Inc.
