Nichia starts to enforce YAG related patents against Everlight's subsidiary and distributor in China
On March 4, 2016, Nichia Corporation (“Nichia”) filed several patent infringement lawsuits in China at Beijing Intellectual Property Court against Everlight Electronics (China) Co., Ltd. (“Everlight China”) and Beijing Ducheng Yiguang Electronic Devices Selling Center, etc.
Everlight China is a subsidiary of Taiwanese LED manufacturer Everlight Electronics Co., Ltd. (“Everlight”) and Beijing Ducheng Yiguang Electronic Devices Selling Center is an authorized distributor of Everlight.
In the lawsuit, Nichia is seeking a permanent injunction and damages against defendants based on Nichia’s YAG related patents (Chinese Invention Patent No. 97196762.8 (“762 patent”) and Chinese Invention Patent No. 200610095837.4 (“837 patent”)). Nichia believes that LED products 334-15/T1C1-4VXC-L(ES) and 67-21UMC/S3031/TR8/LT, which were sold in China, infringe the 762 patent and the 837 patent, and LED product 67-21S/KK2C-H6565M41N42936Z6/2T, which was also sold in China, infringes the 762 patent.
Nichia seeks to protect its patents and other intellectual property rights and takes actions against alleged infringers in any country where appropriate and necessary.
