Nichia Initiates DE Lawsuit Against Seoul Semiconductor's Acriche Products

On July 7, 2008, Nichia Corporation (“Nichia”) filed a patent infringement lawsuit in Germany against a Korean company, Seoul Semiconductor Co. Ltd. (“Seoul Semiconductor”), a German subsidiary of Seoul Semiconductor, Seoul Semiconductor Europe GmbH, and its German distributor, Conrad Electronic SE seeking injunctive relief and compensation for damages.

The subject of this lawsuit, seeking an injunction and recovery of damages, is against the Acriche Series White LED product manufactured by Seoul Semiconductor, which Nichia believes infringes their patent [EP(DE)622858]. As one of the main products of Seoul Semiconductor, these Acriche products are also being used for streetlights in Europe.

In order to protect its intellectual properties, Nichia has also filed lawsuits in the U.S., Japan, Korea and the U.K against Seoul Semiconductor and its Japanese and U.S. subsidiaries for injunctive relief and compensation for damages, which are all currently pending:

1. The U.S. lawsuit for design patent infringement of side-view white LEDs ( The jury affirmed Seoul Semiconductor's willful infringement of Nichia design patents )
2. The,1st Japanese lawsuit for patent infringement of white power LEDs and the 2nd Japanese lawsuit for patent infringement of chip-type white LEDs .
3. The 1st Korean lawsuit for patent infringement of chip-type white LEDs and the 2nd Korean lawsuit for patent infringement of white power LEDs .
4. The U.K. lawsuit for patent infringement of Acriche Series White LEDs .
